About 3 months ago me and a friend had just left another friends house and were late for a train so we decided to run to the traion station, as we started running from his house a Police car came up behind us and stopped us and searched us saying they thought we had screwdrivers etc. and they thought we were running from a 'scene of crime' as there had been someone reporting trouble arround there earlier that week, they gave me a copy of this piece of paper that apparently they keep on record.. It had my height hair colour clothes etc. on and it also said the reason for the stop and search was because I was 'running from the police car' when they were trying to stop us, this is rediculous as we didn't even see it was a police car until it was infront of us.. My friend had a woman policewoman wright his which didn't say this and just said it was a random stop, whereas mine doesn't.

Unfortunately whatever the reason for the Police stopping you, they can justify it by citing reasonable suspicion.
OK you do not consider their reasons for stopping you to be reasonable, but what are you going to do? They will obviously ,to cover their actions, cite your actions on the forms to justify their decisions.
Does it stink? course it does but there is no power on this earth, with the legislation on stop n search being what it is, to get the Officers to retrospectively admit they got it wrong.

If they have probable cause they can. Probable casue is basically anything that causes suspicion. They has a crime they were investigating and you were near the scene and running. That would be enough to make a reasonable person suspicious, if you were in there shoes. They can stop you, they just can't hold you very long without charging you for something.

Yes the police can search you without evidence, they thought it was suspicious that you were running and there was a crime in the area. They will keep that on your record for a year or so then it will be deleted, you can also go to the station and ask the police officer about all your queries and then they'll be able to tell you in more detail since i don't know if your in the UK or the US

I doubt there will be any report made on you. If you had been the victim of a crime wouldn't you want the police to stop someone who matched the description of the perpetrator? I really don't think you have anything to worry about.

This happened to my 14 year old daughter the other night.It was roughly 5:30pm and she was running back to our house with her friend after going to get a DVD from her friends house.Both girls were given a pink slip,searched and their details were written down.At first I was furious but I discovered the next day that earlier on in the evening,a little girl had been sexually abused in the court they were running from.They weren't suspected from what I can gather,more potential witnesses although this wasn't mentioned to either girl at the time.My daughter was kinda blase about the situation but her friend was so shaken up by the situation she couldn't even spell her name aloud because she was so alarmed at the situation.
I believe the police are able to stop and search by law if they think you could have witnessed or indeed participated in a crime.
Edit:I'm also p'ed off that they put on both the girl's pink slips that they were running away,running away from what? Their house,how bloody stupid are they,they only had to go to my daughters friends parents house to corroborate their story.

If the officer had any suspicion whatsoever, yes he has a right to stop you. After all, you were running from an area that had been reported as having been a week ago burglarized. All you had to do was give them permission to search, let them search, and they would have said nothing more. The piece of paper you are talking about is a BOLO (be on the lookout) which was produced at the time the crime was reported. There is also a criminal history check which will show all the statistics that you told about. This is a common procedure for any traffic stop.

It's not going to stay on your record because you don't have one. When you get convicted in a court for a crime then you have a record.
The cop wrote you up for many reasons.
1.He needs to show his superiors he is doing his job.
2.In case you just finished committing a crime they can track you down.
3.cops are suppose to show the tax payers that they are working and by writing down information about a stop on a pad they are showing that they are working.
You don't have a record buddy. You worry to much. When ever you appear before a judge for a criminal crime then you have to worry.

It is not constitutional to be searched without cause by the police. However, depending on where you are from, it may be best to co-operate with the police because they can create reasons to stop and search you. If this is an isolated incident, you may best forget and move on. If it happens frequently, buy youself a good pen recording device and see what happens when you refuse being searched. You will need evidence to fight any illegal search and arrest by police.
Believe me, abuse of police powers happens all the time and they get away with it because the courts are prone to believe the police over the public. The only time they are caught is when someone is taking a video.

They filled out a stop and frisk card to document their probable cause for stopping you and patting you down for weapons.
You where not even arrested, so their is no permanent record. They keep those cards in an internal file. They go nowhere and can not be accessed by anyone other than the local police. if a crime is committied, they often look back at stop and frisk cards to see if a person was stopped. many times they catch people this way.
The cards will sit in some file somewhere. All it means is that you where stopped and is a record of that stop to protect the police. It will not effect you in any way, shape matter or form.

It may stay in some database, but nothing goes on your record unless you are charged or convicted of a crime.

Other than that you only get a criminal file if you are arrested and either remanded in custody or Court Convicted. The stop and search were completely legal, I wouldn't worry about it too much unless you do have something to hide that is. J

under pace (police and criminal evidence act) 1984 say the police have to right to stop and search person/persons in an area where an alleged offence has occured or in progress to confirm or deny a person/persons involvement in an offence normally police would do so if you where in an area where something had or was happening because you were running would give reasonable cause to believe you were running from someone or something ie the police it is part of the illimination process so yes they have the right sorry to say mate as much as it annoys and inconveniences people they can and will continue to do this

if you had been robbed or assaulted would you not want the police to stop two men running. I would. Sometimes we have to take a bit of discomfort in order to have ful protection.
I would have to insight to accept they were doing a difficult job and thank them for stopping me. What if you were two criminals on the run, carrying knives ? I would say the police were brave putting their lives on the line to protect us.

police normally keep a note of things that happen on their watch, so writing down details of the stop and search are not uncommon, methinks you are worrying unduly

It was case of you and your friend being in the" wrong place at the wrong time". There had been some trouble in that area so they were within the law to stop you and search you, you believe this or not last year on my way home, it raining very hard so i sheltered in a shop door way, not knowing that the day before the shop had been targeted by robbers. I do not live in area that I am stationed, the car passed me and turned around and came back, before they said anything I got out my warrant card, we had a laugh. and I got a lift home.

I appreciate what you are saying and the circumstances as to why you were running.
I think the officers could have been a little more informative as to why they stopped you and the reasons for searching you. The form they completed was a search record (or a Gen 164). This is recorded on a computer (for admin purposes only) and kept for 7 years. It doesn't show up on any checks made by the police as you have done nothing wrong.
Obviously the police perceived that you were running from them. The fact that they stopped you shows that they were doing their job. Don't take it personally and don't get hung up about the search record.
